All while drinking and drugs in car
DELMAR – A 24-year-old Oak Hill man was driving his gray 2014 Chevrolet Malibu on Delaware Avenue on Monday, Jan. 1 at 12:43 a.m. and Bethlehem police observed the vehicle almost hit a curb and swerve back into the lane of travel. The officer turned and followed the vehicle and performed a DMV check which showed its inspection expired in May.
Officers observed the vehicle to go over the yellow line before and after trying to pull over the vehicle. Upon interviewing the man, officers observed that he had slurred speech, bloodshot and watery eyes and had a strong odor of an alcoholic beverage emanating from his breath. He was also unsteady on his feet while standing.
The man was given and failed field sobriety tests and tested positive for breath alcohol on a pre-screening device and taken into custody for DWI.
During an inventory of the vehicle, officers found an unfinished and open container of an alcoholic beverage and a xanax pill in the cup holder. The man said he did not have a prescription for the drug.
At the police station, the man provided a breath sample that returned a .19 percent BAC. He was charged with aggravated DWI, aggravated unlicensed operation, and criminal possession of a controlled substance, all misdemeanors, and ticketed for unsafe lane change, drinking in a motor vehicle, not having a controlled substance in a non original container and no inspection sticker.
The man was released with an appearance ticket for Bethlehem Town Court on January 16.
Warrant
DELMAR – On Saturday, Dec. 23 at 4:36 a.m. a Bethelhem police unit observed a man walking from behind a business on Delaware Ave towards the road. The officer recognized Albert Lindh, 33, who is homeless, from prior encounters with him and believed he had an outstanding warrant.
The warrant from Albany County Court was confirmed by dispatch and Lindh was taken into custody in front of Stewarts after a brief struggle.
Lindh was taken to Albany Medical Center Hospital by Delmar-Bethlehem EMS for a pre-existing injury sustained two weeks prior. At the hospital charged with resisting arrest, a misdemeanor, processed on the warrant and then transported to Albany County jail.
DWI on Route 85
SLINGERLANDS – A 26-year-old Delmar man was driving a blue 2015 Subaru Legacy at approximately 12:49 a.m. on Sunday, Dec. 31 on Route 85 when Bethlehem police clocked the vehicle traveling 71 mph in a 55 zone.
The officer performed a traffic stop and, after a DMV check, observed the registration and inspection expired in April and May, respectively. While interviewing the man, the officer observed the man to have bloodshot, droopy and watery eyes and he had an odor of an alcoholic beverage emanating from his breath.
The man was given and failed field sobriety tests, tested positive for breath alcohol on a pre-screening device and taken into custody. At the police station, the man refused to take a breath test twice, but then submitted to one at 1:44 a.m. and provided a breath sample that returned a .09 percent BAC.
The man was charged with DWI, a misdemeanor, and operating an unregistered and uninspected vehicle, and ticketed for speeding.
He was released with an appearance ticket for Bethlehem Town Court on January 16.
No lights, license, registration or inspection, flees police
GLENMONT – On Saturday, Dec. 30 at approximately 9:57 p.m. Bethlehem police observed a 2015 Jeep Cherokee traveling southbound on Route 9W without a plate lamp and the officer attempted to stop the vehicle. The driver conducted a U-turn near the intersection of Route 9W and Route 32 and entered 787. Police discontinued the chase at that point.
The officer did see the face of the driver while he was making the U-turn and positively identified him as a 21-year-old Selkirk man from a photo of the registered owner of the Jeep.
The next day, officers attempted to locate the man at the listed address on his license, but did get in touch with a relative.
The man turned himself in to police later that day. He was charged with aggravated unlicensed operation and unlawfully fleeing a police officer, both misdemeanors, and ticketed for no plate lamp, operating a unregistered motor vehicle, operating without a license, no registration, speeding, failing to keep right and failing to notify of change of address.
The man was released with an appearance ticket for Bethlehem Town Court on January 16.
