Albany County District Attorney David Soares announced Judge Dan Lamont on Friday, June 22, sentenced Kolby Martin, 28, of Schenectady, to 25 years in state prison and five years of post-release supervision.
On April 16, Martin was found guilty after a jury trial of attempted murder in the second degree, criminal use of a firearm in the first degree, criminal possession of a weapon in the second degree and two counts of criminal possession of a weapon in the second degree, all felonies.
Police said on Aug. 24, 2011, in the area of Clinton Avenue and Judson Street, Martin shot at an unknown man while driving by in an SUV. Martin and the driver of the SUV fled the scene while being chased by marked police cars, according to police. After they were caught and taken into custody, a search for weapons by the Albany Police Department discovered a revolver and a semi-automatic pistol in a wooded area on North Manning Boulevard, which was passed by during the pursuit.
The revolver had been reported stolen. Both guns were found loaded and were positively test fired.
Assistant District Attorney Dan Lynch of the Street Crimes Unit handled the prosecution of the case.
