A Supreme Court judge declared Akiva D. Abraham’s arson case a mistrial, on Tuesday, Dec. 29, according to the judge’s office.
According to information from Supreme Court Justice Dan Lamont’s office, nine out of twelve jurors favored a conviction, but ultimately the jury could not come to a unanimous decision one way or the other.
The jury began deliberation on Tuesday, Dec. 22, and deliberated Dec. 23 and Dec. 28, before begin discharged Tuesday.
Abraham was arrested on Friday, May 15, on charges of arson, insurance fraud and falsifying business records after Saratoga Winners, a former factory, concert venue and bar off Route 9 in Colonie, was burned down in the middle of the night.
