The winner of the Bethlehem Working Families Party primary will soon be known, a month-and-a-half after Primary Day.
The state Court of Appeals announced this morning that it will not hear an appeal filed by Sam Messina on the latest court decision that ordered 11 absentee ballots to be opened. Those ballots will be opened at 1 p.m. today, according to the Albany County Board of Elections, and the outcome of the race will be known soon afterward.
The BOE cannot program voting machines or send out absentee ballots until the result of the race is known.
Without counting the absentee ballots in question, Messina has 11 votes and incumbent Jack Cunningham, who staged a write-in campaign for the line, has five. There are 28 voters in Bethlehem registered with the WFP, including the voters whose ballots remain sealed.
Messina will appear on the Republican and Conservative lines, and Cunningham will appear on the Democrat and Independent lines.
