DELMAR – On Monday, September 4 at approximately 12:10 AM, Bethlehem police responded to a call for a larceny in progress at Jim’s Tastee Freeze at 58 Delaware Avenue.
According to reports, the incident involved two males who were stealing the ATM machine from the ice cream stand.
Upon arrival of officers, one suspect was taken in custody and the second suspect was located a short time later on Delaware Avenue.
The suspects in the case are identified as William C. Kennedy, 51, who is homeless, and John Carroll, 54, of Albany.
Both suspects were charged with criminal mischief and grand larceny, both felonies, and conspiracy, a misdemeanor.
They were arraigned in Bethlehem Town Court by Judge Ryan Donovan.
Carroll was released on his own recognizance and Kennedy was sent to Albany County Correctional Facility with no bail due to two prior felony convictions and the judge must remand in that situation according to State Law.
A return date has been set for September 7 in Town of Bethlehem Court.
