The Colonie Police Department made an arrest in connection with the attempted armed robbery that occurred on Monday, July 4 at 5:14 a.m. at the McDonalds 256 Osborne Road.
Colonie police arrested Jose Rivera Jr., 38, of 256 Third Street Apartment 1 Albany, NY Wednesday, August 6. The BB gun allegedly used in the attempted robbery was recovered. Rivera is the suspect that was armed with the handgun during the robbery and also struck the female employee in the head.
Rivera was an employee of the restaurant at the time of the robbery. The suspect that stayed by the door during the robbery has been identified and charges are pending.
Rivera is facing felony charges for three counts of attempted robbery in the second degree, Criminal Possession of a Weapon and assault.
The Rivera will be arraigned in Colonie Justice Court the evening of Wednesday, August 6 at 6:00 p.m.
