A Clifton Park woman was arrested under Leandra’s Law after blowing a .35 BAC and having two children under the age of 16 in the car, according to State Police reports.
On Wednesday, Aug. 24, around 3:50 p.m., a State Trooper was flagged down by a 48-year-old Saratoga Springs woman who said her car had just been hit in a parking lot adjacent to Aviation Road in the Town of Queensbury by a Volkswagen that was leaving the scene, said police.
According to police reports, the trooper observed the vehicle leaving the parking lot and stopped the car on Aviation Road where the driver was identified as Christian L. Rice, 44, from Clifton Park, who denied hitting the other vehicle, although she had fresh damage on her vehicle.
It became apparant that the driver was intoxicated and she was subsequently arrested for DWI, said police. Rice had two children under the age of 16 in the vehicle so the DWI charge became a felony under Leandra’s Law, with additional arrests for leaving the scene of an accident and endangering the welfare of a child, said police. Rice’s Breathalyzer result was a .35, which added an aggravated DWI charge, which is applied when a test result is .18 or greater, said police.
Rice was remanded to the Warren County Jail in lieu of $2,500 bail or $5,000 bond.
