According to Sheriff Craig Apple, Jesse Burby shot the co-worker in the arm while the two were working at the county DPW garage in New Scotland on Monday, Jan.6. He then threatened the co-worker by pointing the Bostich Smartpoint nail gun at other body parts.
The victim was taken to an area hospital have the nail surgically removed.
Burby was charged with one count of felony assault as well as the misdemeanors of criminal possession of a weapon and menacing.
According to county spokeswoman Mary Rozak, Burby started working with the county in 2013. He is currently suspended without pay.
