The group of merchants that had met with the Town of Colonie last month regarding the Second Hand Dealers Law have now drafted their own version.

, clarifies in detail what items would be covered under the law and also defines what would be considered a Collateral Loan Broker and a Secondhand Dealer.
For example, a Secondhand Dealer, as defined in the proposed law, say it includes, any person, company, corporation, or member or members of a partnership or firm regularly engaged in the business of purchasing or consigning Secondhand Articles from the general public…
Also included is an entry regarding garage sale operators. If a person holds a garage sale less than three weekends per year, they would not be considered under the law. This also includes those doing business over the internet, as well as dealers outside of the Town of Colonie.
The proposed law also says that a license is required for any person or company that acts as a dealer, but says anyone acting as an employee of the licensed dealer will not be required to obtain a license.
When recording items, the proposed law says the dealer must record any items received with a value exceeding $50 by a handwritten entry or through electronic means. It also lists, in detail, what must be included in the entry. A dealer must also not purchase items from anyone under the age of 21.
Martin Finkle, owner of Harold Finkle Jewelers, said there has not been a meeting since the first one that occurred in April.
`We feel it is a good law to deal with the situation as we see it,` he said.
