Town board member Ulderic U.B. Boisvert has agreed to attend drunken driving programs as part of his driving while ability impaired plea in Edinburg Town Court Monday, Aug. 6.
Boisvert originally faced driving while intoxicated charges stemming from a June accident on his all terrain vehicle.
Boisvert accepted a charge of driving while ability impaired and, in addition to attending a drunk driving program and victim impact panels, he will be issued a conditional license for work purposes only, said his lawyer Arnold Proskin.
The non-criminal DWAI violation is his first alcohol-related incident and traffic violation, Proskin said.
`U.B. is very embarrassed. He was hurt badly in this. Thank goodness he is alive, and he hopes people will learn from this,` he said.
Proskin said Boisvert accepted the plea to take responsibility for his actions, which is typical of first time offenders.
Boisvert crashed the ATV along Park Road in the town of Edinburg near his summer camp. While driving on the left shoulder of the road, he took his hand off the handlebars and lost control of the vehicle. The ATV overturned and threw Boisvert out onto the road. He was not wearing a helmet. He suffered injuries on the left side of his body.
The first-term Republican, who is seeking re-election this year, will stay on the ballot to vie for a second term and has the support of the town’s Republican committee and fellow board members.
Boisvert apologized for his actions and added that it in no way will affect his ability to govern Colonie.
`I would like to apologize to my wife and family. I made a mistake. At no time did it affect my ability to help govern the town or do the work of the people,` said Boisvert.
He didn’t try to run from the incident, or subsequent charges, that is why he made the plea bargain, he said.
